1. Operator and scope
JAE Music is an independent, privately operated music-curation project based in the Netherlands. It is not presented as a registered company. “JAE Music” in these terms means the private operator of the project.
These terms apply to paid Spotify playlist research and outbound curator outreach requested through the JAE Music playlist-promotion page. They do not reduce mandatory consumer rights or other rights that cannot legally be excluded.
2. Requests, approval and contract formation
Submitting the online form is a request, not automatic acceptance and not an immediate payment obligation. JAE Music reviews each request manually. If the request is accepted, the customer receives payment instructions for the selected package.
The service agreement is formed when the approved customer completes payment using the supplied Ko-fi or Bunq link and that payment is verified. The approval email, selected package, these terms and the recorded campaign information together describe the agreement.
Customers must be at least 18 years old and able to enter the agreement. The customer is responsible for supplying an accurate email address, public Spotify track URL and campaign information, and for having the rights or permission needed to promote the track.
3. What the service includes
The selected package pays for the stated number of targeted, individual outbound playlist pitches for one Spotify track. JAE Music researches possible targets based on signals such as genre, sound, mood, apparent fit and available curator information, then sends those pitches only to independently selected curators in JAE Music’s external outreach network. A paid campaign does not submit the track to JAE Music’s own playlists.
The current opening-offer packages include an editable Excel (.xlsx) delivery report showing the available outreach status at the time of reporting. The sheet may contain Pending statuses and is not a live feed; the customer can update their own copy if later information becomes available. A report is evidence of outreach activity and a dated status snapshot, not a prediction, testimonial or result guarantee.
4. Price and payment
The package and total euro price shown in the approval and payment email apply to that request. Introductory pricing may change for future requests, but not after a price has been accepted and paid for the current request.
Ko-fi or Bunq handles the payment interface and its own payment terms may also apply. JAE Music does not collect card numbers, bank-login credentials or full payment credentials. Payment must use the same email or campaign reference requested in the approval instructions so it can be verified.
5. Campaign start and reporting
Payment does not itself mean that outreach has started. When JAE Music starts the campaign, it records the start time and queues a separate campaign-start email in the same admin action. The first report is due within three calendar days after that recorded start; delayed email delivery does not extend the deadline. Independent curator decisions may remain pending after the report.
Starting within the statutory withdrawal period is optional. If the customer separately and expressly requests an early start, that exact request, timestamp and wording are stored. Without that request, the campaign does not start until 14 complete calendar days after payment was confirmed.
6. Statutory withdrawal and cancellation
Where a statutory consumer right of withdrawal applies, the customer may withdraw without giving a reason within 14 days after the service agreement is formed. The customer can use the public Withdraw from a purchase function or email an unambiguous withdrawal statement to info@musicbyjae.com.
- Before campaign start: JAE Music provides a full refund when a valid withdrawal or agreed cancellation is received before work starts.
- After an expressly requested early start: if the customer withdraws after work has begun, JAE Music may account only for the proportion of the agreed service demonstrably performed up to receipt of the withdrawal, subject to mandatory law.
- After full performance: the statutory right may end once the service has been fully performed following the customer’s express early-start request and legally required acknowledgement, where the law permits that result.
- If JAE Music cancels: JAE Music provides a full refund if it cancels the campaign.
- Outcomes: after the agreed research and outreach has been performed, a lack of placement, replies, streams or other outcomes is not by itself a refund reason.
Any refund or deduction remains subject to mandatory law. Nothing in these terms asks a customer to waive a right that cannot legally be waived. The automated withdrawal email confirms receipt only; JAE Music reviews the applicable facts before confirming the resolution.
7. Customer responsibilities and prohibited use
The customer must not submit unlawful, infringing, impersonating, fraudulent or misleading material; use the service to manipulate streams or platform metrics; or claim that a pitch guarantees curator support. JAE Music may refuse or stop a campaign where continuing would be unlawful, unsafe, deceptive or materially different from the approved request.
The customer retains rights in the music and supplied materials and gives JAE Music a limited permission to use them only as reasonably needed to review, pitch, report on and administer the campaign.
8. Independent services, responsibility and disputes
Spotify, Ko-fi, Bunq, Cloudinary and independent curators are separate services or decision-makers. JAE Music cannot control their availability, policies, response times or editorial choices. JAE Music remains responsible to the extent required by applicable law and does not exclude liability where exclusion is prohibited.
Dutch law applies, without depriving a consumer of mandatory protections that apply in the consumer’s country of residence. Please first email info@musicbyjae.com so a concern can be reviewed directly.
9. Changes and contact
The terms version displayed and recorded when the request form is accepted applies if that request is later approved and paid. Later edits do not replace the recorded version for that order unless a change is required by law or expressly agreed. Future versions apply only to later requests.
